By accessing this website, creating an account, purchasing a product, downloading content, submitting an inquiry, joining our mailing list, or booking a service, you agree to these terms. If you do not agree, please do not use the website or purchase our products or services.
Terms & Conditions
1. WEBSITE PURPOSE

Unless expressly stated otherwise, products offered through this website do not include alcoholic beverages.
We may add, remove, modify, suspend, or discontinue website content, products, services, or features at any time.
2. ELIGIBILITY
You must be at least 13 years old to use the website. You must be at least 18 years old, or the age of legal majority where you live, to make a purchase or enter into a service agreement without the involvement of a parent or legal guardian.
By placing an order or booking a service, you represent that the information you provide is accurate and that you are legally authorized to use the selected payment method.

3. EDUCATIONAL DISCLAIMER
Content provided by Liana Rose Wine is intended for general educational and informational purposes.
Wine, viticulture, enology, laboratory, cellar, vineyard, food, business, and production information may vary depending on the specific product, facility, location, equipment, conditions, and applicable regulations.
Our content is not a substitute for professional, legal, medical, safety, regulatory, agricultural, laboratory, or technical advice specific to your circumstances.
You are responsible for evaluating whether any information is appropriate for your situation and for following applicable laws, product instructions, workplace procedures, and safety requirements.
We make reasonable efforts to provide accurate information, but we do not guarantee that every statement will be complete, current, error-free, or suitable for every purpose.
4. WEBSITE USE
You agree not to:
-
Use the website for unlawful, fraudulent, or abusive purposes.
-
Attempt to gain unauthorized access to the website, customer accounts, servers, or connected systems.
-
Upload malware, harmful code, automated scraping tools, or disruptive material.
-
Copy, reproduce, distribute, sell, republish, or commercially exploit protected website content without permission.
-
Misrepresent your identity or your relationship with another person or organization.
-
Interfere with the operation, security, or availability of the website.
-
Use our products, downloads, photographs, graphics, or educational materials to train an artificial intelligence system or create competing commercial materials without written permission.
We may restrict or terminate access when we reasonably believe a user has violated these terms or misused the website.

5. ACCOUNTS AND MEMBERSHIP FEATURES
Certain website features may allow you to create a Liana Rose Wine Wix member account.
You are responsible for maintaining the confidentiality of your login information and for activity occurring through your account. Please notify us promptly if you believe your account has been accessed without authorization.
We may suspend or close accounts that contain false information, violate these terms, infringe intellectual property rights, or create security or legal concerns.
Creating a free website account does not guarantee continued access to any particular resource, benefit, product, or service unless otherwise stated.
6. PRODUCT INFORMATION AND PRICING
We make reasonable efforts to display product descriptions, images, dimensions, colors, features, prices, and availability accurately. Colors and appearance may vary depending on your device, screen settings, printing process, and materials.
Prices are listed in the currency shown at checkout and may change without notice. Applicable taxes, shipping charges, customization fees, and other charges will be displayed before the order is completed whenever reasonably possible.
Placing an order does not guarantee acceptance. We may cancel or refuse an order because of inventory errors, pricing errors, suspected fraud, payment issues, shipping limitations, or other reasonable business concerns. If we cancel a paid order, we will refund the amount paid for the cancelled portion.

7. PAYMENT PROCESSING
Payments may be processed through Wix Payments or another third-party payment provider displayed at checkout.
Payment providers may collect and process billing information according to their own terms and privacy policies. Liana Rose Wine generally does not receive or store your complete payment-card number.
You authorize us and the applicable payment provider to charge the payment method you submit for the total amount shown at checkout or stated in an accepted proposal or invoice.
8. PHYSICAL PRODUCT ORDERS
Order Processing
Estimated processing and shipping times are provided for convenience and are not guaranteed delivery dates. Custom, handmade, personalized, printed-on-demand, or preorder products may require additional processing time.
We are not responsible for delays caused by carriers, weather, incorrect addresses, customs procedures, supply interruptions, or events outside our reasonable control.
If we are unable to ship an order within the stated or legally required period, we will provide any notice, cancellation option, or refund required by applicable law.
Shipping Information
Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges caused by an incorrect address, refused delivery, or unclaimed shipment may be the customer’s responsibility.
Ownership and risk of loss generally transfer when the order is delivered to the address provided, except where applicable law provides otherwise.
International customers are responsible for applicable customs charges, duties, import taxes, and local requirements unless checkout specifically states otherwise.

9. RETURNS FOR PHYSICAL PRODUCTS
Unless a product listing states a different policy, eligible physical products may be returned within 14 calendar days after confirmed delivery.
To qualify for a return, the product must be:
-
Unused, unworn, unwashed, and undamaged.
-
In substantially the same condition in which it was received.
-
Returned with its original packaging, tags, components, and accessories.
-
Accompanied by proof of purchase.
-
Approved for return before it is shipped back.
To request a return, contact info@lianarosewine.com with your order number and reason for the return. Do not send a return without first receiving instructions.
Unless the product was damaged, defective, or incorrectly fulfilled, the customer is responsible for return shipping costs. Original shipping charges are not refundable.
Refunds are issued to the original payment method after the return has been received and inspected. Processing times may vary depending on the bank or payment provider.
10. PRODUCTS THAT ARE NOT RETURNABLE
The following products are final sale unless they arrive damaged, defective, materially different from their description, or applicable law requires otherwise:
-
Customized or personalized products.
-
Made-to-order products.
-
Digital downloads and electronically delivered products.
-
Gift cards.
-
Clearance or final-sale products.
-
Products that have been used, altered, washed, damaged, or returned incomplete.
-
Products identified as nonreturnable before purchase.
This return policy does not limit any nonwaivable legal rights relating to products that are defective, damaged, misrepresented, or not delivered.

11.DAMAGED, DEFECTIVE, OR INCORRECT ORDERS
Please inspect physical products promptly after delivery.
If an order arrives damaged, defective, incomplete, or incorrect, contact info@lianarosewine.com as soon as reasonably possible, preferably within seven days after delivery. Include the order number, a description of the issue, and clear photographs when applicable.
Depending on the circumstances, we may offer a replacement, repair, store credit, partial refund, or full refund. We may require the original product to be returned before issuing a replacement or refund.
12. DIGITAL PRODUCTS
Digital products may include guides, workbooks, templates, flashcards, posters, printable materials, courses, videos, photographs, graphics, or other downloadable or electronically delivered content.
Because digital products are made available immediately or shortly after purchase, digital product sales are final and are not eligible for return, exchange, or change-of-mind refund after access or delivery, except where required by law.
Please contact us if:
-
You were charged more than once for the same purchase.
-
The file is corrupted or materially defective.
-
You did not receive the access information.
-
The purchased file is materially different from its description.
We will make reasonable efforts to correct the issue, restore access, replace the file, or provide an appropriate refund when the product cannot be delivered as described.

13. SERVICES, PROJECTS, AND BOOKINGS
Services may include photography, videography, drone services, marketing, social media management, consulting, education, graphic design, custom artwork, content production, or similar professional work.
Specific services may be governed by a separate proposal, estimate, statement of work, invoice, or written contract. If that document conflicts with these website terms, the project-specific document will control for that project.
Deposits
Unless a proposal or contract states otherwise, a deposit equal to 50% of the estimated project fee is required to reserve a project date, production period, or service capacity.
The deposit is applied toward the total project price. Deposits are generally nonrefundable to the extent permitted by law because LRW reserves time, limits other bookings, performs administrative work, and may begin planning or preparation after payment.
A project is not considered booked until the required deposit and requested agreement have been received.
Client Cancellation
If the client cancels a project:
-
The deposit may be retained to cover reserved time, administration, planning, preparation, and reasonably anticipated losses.
-
The client remains responsible for work already completed and approved non-cancellable expenses.
-
Any amount paid beyond the deposit and amounts already earned will be refunded when applicable.
-
No refund will be issued for completed or delivered services.
These terms do not permit LRW to retain an amount that would constitute an unlawful penalty under applicable law.
Rescheduling
Rescheduling requests are subject to availability and must be submitted in writing.
We will make reasonable efforts to accommodate a requested date change. A new deposit or rescheduling charge may be required when notice is insufficient, expenses have already been incurred, a date cannot reasonably be rebooked, or the project has previously been rescheduled.
Weather-dependent photography, drone, vineyard, or outdoor work may be rescheduled when LRW determines that weather, safety, legal, equipment, location, or flight conditions make the work inadvisable.
Cancellation by Liana Rose Wine
If LRW must cancel a project and cannot provide a reasonable replacement date or alternative arrangement, we will refund amounts paid for services that were not performed.
LRW will not be responsible for indirect losses caused by cancellation, including lost profits, travel expenses, missed opportunities, or fees owed to unrelated vendors, except where applicable law requires otherwise.
Scope Changes and Additional Work
The price includes only the services, deliverables, revisions, locations, usage rights, and schedule stated in the applicable proposal or agreement.
Requests that materially change the scope may require a revised timeline and additional fees. Additional work must be approved in writing before it is performed whenever reasonably possible.
Client Responsibilities
Clients are responsible for:
-
Providing accurate instructions, information, brand assets, approvals, and access.
-
Obtaining location permissions, releases, licenses, or authorizations assigned to the client under the project agreement.
-
Reviewing drafts and providing feedback within the requested timeframe.
-
Ensuring that submitted materials do not infringe another party’s rights.
-
Paying invoices according to their stated due dates.
Delays in client feedback, access, approvals, or materials may extend the project timeline.
Final Payment and Delivery
Unless otherwise stated, remaining balances are due by the invoice due date and may be required before final high-resolution files, unwatermarked materials, publication rights, or final deliverables are released.
We may pause work or withhold final delivery while an invoice remains overdue.

14. PROMOTIONAL CODES
Promotional codes:
-
Must be used before their expiration date.
-
Cannot be redeemed for cash.
-
Cannot be combined unless expressly permitted.
-
May be limited to specified products, customers, or purchase amounts.
-
May be cancelled when obtained or used fraudulently.

16. USER-SUBMITTED MATERIALS
When you voluntarily submit a review, testimonial, photograph, comment, message, tag, or other content, you represent that you have the right to submit it and that it does not violate another person’s privacy, copyright, trademark, or other rights.
We will request permission before using identifiable customer content in advertising when permission is legally required or when the intended use materially differs from the context in which it was submitted.
We may remove website comments, reviews, or submissions that are unlawful, misleading, abusive, infringing, irrelevant, or inappropriate.
17. THIRD-PARTY LINKS AND SERVICES
The website may contain links to or integrations with third-party websites, applications, social media platforms, payment processors, shipping carriers, analytics providers, or other services.

Nothing in these terms excludes warranties or consumer rights that cannot legally be waived.

20.LIMITATION OF LIABILITY
To the fullest extent permitted by law, Liana Rose Wine LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, products, services, downloads, third-party services, or reliance on educational content.
Where liability cannot be excluded entirely, our aggregate liability will not exceed the greater of:
-
The amount you paid to Liana Rose Wine for the product or service giving rise to the claim; or
-
One hundred United States dollars.
These limitations do not apply to liability that cannot legally be limited, including any rights or remedies that applicable consumer law makes nonwaivable.
